Which Partner Visa Do You Need?
Onshore Partner Visa (Subclass 820/801) — For applicants already in Australia. You apply for the temporary Subclass 820 first, then transition to the permanent Subclass 801 after two years. You can work and study in Australia while your application is being processed.
Offshore Partner Visa (Subclass 309/100) — For applicants outside Australia. The Subclass 309 is granted first (provisional), followed by the permanent Subclass 100. Your partner can join you in Australia once the 309 is granted.
Prospective Marriage Visa (Subclass 300) — If you are engaged but not yet married, this visa allows your fiancé(e) to travel to Australia to marry. You must marry within nine months of arrival and then apply for a partner visa.
Who Qualifies?
Both married and de facto couples are eligible. For de facto relationships, you must have been living together for at least 12 months before applying (with some exceptions). Same-sex couples are equally eligible under Australian law.
What Evidence Do You Need?
The Department of Home Affairs assesses your relationship across four categories: financial aspects, nature of household, social aspects, and commitment.
